This is a legal Agreement between you, the "End-User" and HER MAJESTY THE QUEEN IN RIGHT OF CANADA ("Canada"), represented by the Minister of Natural Resources Canada ("NRCan").
Terms and Conditions for the Use of the CSRS Online Database
The End-User acknowledges that the CSRS Online Database and its contents, which are prepared or published by NRCan, are protected under the Copyright Act of Canada and belong to NRCan.
The End-User shall not sell, loan or transfer information acquired from the CSRS Online Database or otherwise assign any rights under this Agreement to any third party without prior permission of NRCan.
If the End-User wishes to produce a product for retailing or other purposes using information acquired from the CSRS Online Database, a licensing agreement will be required and may be negotiated with NRCan to authorize the development and/or sale of such a product.
The information included in the CSRS Online Database is provided on an "as is" basis and Canada makes no guarantees, representations, or warranties respecting the information, either expressed or implied, arising by law or otherwise, including but not limited to, effectiveness, completeness, accuracy, or fitness for a particular purpose.
Canada shall not be liable in respect of any claim, demand, or action, irrespective of the nature of the cause of the claim, demand, or action alleging any loss, injury or damages, direct or indirect, which may result from the End-User's use of the CSRS Online Database or its contents, or in any way relating to this Agreement. Canada shall not be liable in any way for loss of profits or contracts, or any other consequential loss of any kind resulting from any defect in the CSRS Online Database or its contents.
The End-User shall indemnify and save harmless Canada and the Minister from and against any claim, demand, or action, irrespective of the nature of the cause of the claim, demand, or action, alleging loss, costs, expenses, damages, or injuries (including injuries resulting in death) arising out of the End-User's use of the CSRS Online Database or its contents, or in any way relating to this Access Licence.
The CSRS Online Database Access Licence will run for 365 days from the date of activation. Prior to the end of the licence period, the End-User may request an additional 365 days at no charge.
The Access Licence includes unlimited access to the GSD Federal Control Networks, CACS data, and Geodetic Survey Division software.
Users of Geodetic Survey Division markers must obtain permission from the land owner before entering private property.
This agreement shall be interpreted in accordance with the laws in force in the Province of Ontario, Canada.
The End-User has read and understands the above noted terms and conditions and hereby agrees to adhere to these terms and conditions.
